These Terms and Conditions govern all services provided by Escape Society.
By confirming participation in writing and paying the required deposit, the Participant acknowledges having read, understood, and fully accepted these Terms and any applicable annexes.
1. Formation of the Contract
Escape Society does not provide online booking.
A binding contract is formed when:
- The Participant confirms the quotation in writing; and
- The required deposit is received by Escape Society.
The quotation, trip description, and any annexes form an integral part of the contract.
2. Nature of the Activities & Assumption of Risk
Escape Society organizes outdoor, adventure, cycling, mountain, and high-altitude experiences.
The Participant acknowledges that such activities involve inherent risks, including but not limited to:
- Falls and collisions
- Serious bodily injury, permanent disability, or death
- Altitude sickness
- Extreme weather conditions
- Terrain hazards
- Equipment failure
- Limited or delayed access to medical facilities
- Geographic isolation
The Participant voluntarily assumes all inherent and foreseeable risks associated with participation.
Participation is undertaken at the Participant’s own risk.
3. Physical Fitness & Medical Responsibility
The Participant declares that:
- They are in good physical and mental health;
- They are fit to participate in the selected activity;
- They do not suffer from any medical condition incompatible with the trip.
Escape Society shall not be responsible for medical conditions undisclosed prior to departure.
The Participant authorizes emergency medical treatment and evacuation if deemed necessary.
All medical, evacuation, rescue, and related costs remain entirely the Participant’s responsibility.
4. Mandatory Insurance
Participation is conditional upon holding valid insurance covering:
- Medical expenses abroad
- Emergency evacuation and repatriation
- Mountain rescue and search operations
- Adventure and cycling activities
- Personal liability
Failure to provide proof of adequate insurance may result in exclusion from the trip without refund.
5. Limitation of Liability
To the fullest extent permitted by applicable law:
Escape Society shall not be liable for:
- Indirect or consequential damages
- Loss of enjoyment
- Loss of profit or opportunity
- Personal equipment damage or theft
- Acts of third-party service providers
- Force majeure or extraordinary circumstances
In any event, Escape Society’s financial liability shall be strictly limited to the total amount paid by the Participant for the concerned trip.
Nothing in these Terms excludes liability where exclusion is prohibited by mandatory law.
6. Participant Conduct
Participants must:
- Follow all instructions provided by guides and staff
- Use mandatory safety equipment
- Respect local laws and environments
- Refrain from alcohol or substance abuse during activities
Escape Society reserves the right to exclude any Participant whose behavior:
- Endangers others
- Disrupts the group
- Violates safety rules
No refund shall be granted in such cases.
7. Itinerary Modifications
Escape Society may modify itineraries, accommodations, transportation, or activity timing when necessary for:
- Safety reasons
- Weather conditions
- Operational constraints
- Force majeure
Such changes shall not constitute a contractual breach.
8. Payments
- A 35% non-refundable deposit is required to confirm participation.
- The balance is due no later than 35 days before departure.
- Failure to pay the balance on time may result in automatic cancellation without refund of the deposit.
9. Cancellation by the Participant
Cancellation must be made in writing.
Cancellation fees apply as follows:
- More than 60 days before departure: 35%
- 60–30 days before departure: 60%
- 30–15 days before departure: 80%
- Less than 15 days before departure or no-show: 100%
Non-refundable services remain payable in all cases.
10. Force Majeure
Escape Society shall not be liable for failure or delay caused by circumstances beyond its reasonable control, including but not limited to:
- Natural disasters
- Political instability
- Government restrictions
- Epidemics or pandemics
- Border closures
- Transportation disruption
In such cases, Escape Society may:
- Propose a postponement; or
- Offer a credit; or
- Provide a refund of recoverable amounts only.
No additional compensation shall be due.
11. Indemnification
The Participant agrees to indemnify and hold harmless Escape Society from any claims, damages, or losses arising from:
- Their own actions or negligence;
- Breach of these Terms;
- Failure to comply with safety instructions.
12. Data Protection (GDPR – Swiss FADP – International Clients)
Escape Society processes personal data in compliance with:
- Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR)
- The Swiss Federal Act on Data Protection (FADP / LPD)
- Applicable international data protection laws where relevant

12.2 Categories of Data Collected
Escape Society may collect and process the following data:
- Identity and contact details
- Passport information (where required for travel)
- Emergency contact details
- Travel preferences
- Insurance details
- Health data strictly necessary for trip safety (e.g. allergies, medical conditions, altitude compatibility)
Special categories of data (including health data) are processed only:
- With explicit consent; or
- When necessary to protect the vital interests of the Participant; or
- When required for substantial public interest under applicable law.
12.3 Purpose of Processing
Personal data is processed for the following purposes:
- Organization and management of travel services
- Safety and emergency management
- Communication before and during the trip
- Compliance with legal and regulatory obligations
- Insurance and assistance coordination
Data will never be sold or transferred for commercial exploitation.
12.4 Legal Basis for Processing (GDPR)
Processing is based on:
- Performance of a contract
- Compliance with legal obligations
- Legitimate interests (trip organization, security)
- Explicit consent where required
12.5 International Transfers
Given the international nature of travel services, personal data may be transferred to:
- Local partners
- Accommodation providers
- Transport operators
- Insurance and assistance companies
Such transfers may occur outside the European Union.
Where required, Escape Society implements appropriate safeguards in accordance with GDPR requirements.
12.6 Data Retention
Personal data is retained only for as long as necessary for:
- Contractual obligations
- Legal compliance
- Liability and insurance purposes
After this period, data is securely deleted or anonymized.
12.7 Rights of Participants
Participants have the right to:
- Access their data
- Rectification
- Erasure
- Restriction of processing
- Objection
- Data portability
Requests must be submitted in writing to contact@escape-society.com.
Escape Society may request proof of identity.
A response will be provided within a maximum period of three (3) months, in accordance with GDPR and applicable regulations.
12.8 Security Measures
Escape Society implements appropriate technical and organizational measures to ensure:
- Confidentiality
- Integrity
- Protection against unauthorized access
- Protection against accidental loss or destruction
12.9 Complaints
EU residents may lodge a complaint with their local data protection authority.
Swiss residents may contact the Federal Data Protection and Information Commissioner (FDPIC).
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Principality of Andorra.
Any dispute shall be subject to the exclusive jurisdiction of the courts of Andorra la Vella, except where mandatory consumer protection rules provide otherwise.
